Liability Protection

In 1996, the Bill Emerson Good Samaritan Act was signed into law, protecting any person or organization who donates food to a non-profit organization.

Michigan’s own Good Samaritan statute limits the liability for such donations, provided that the donation is given in good faith and ultimately distributed to needy individuals through a charitable organization.

As long as the donor does not act with negligence or intentional misconduct and sees the food as fit for human consumption they are not liable for damage incurred as a result of illness or disease contracted by the ultimate recipient.
